Plaintiff, Stanley J. Kozlowski, as owner, instituted this suit against the defendants, Harry S. Fowler, contractor, and his insurer, American Employers Insurance Company, endeavoring to recover the sum of $975, together with attorney's fees, as damages for the breach of a written building contract entered into on August 10, 1951, by the aforementioned parties.

The defendants pleaded the exceptions of no cause or right of action, which were overruled...
