This is an appeal from a conviction and sentence for refusing to submit to induction into the armed services in violation of the provisions of the Universal Military Training and Service Act, 50 U.S.C.A.Appendix, § 451 et seq. The case was tried by the judge below without a jury. Appellant admits that he refused to submit to induction but contends that the order under which he was required to report was void because arbitrary and capricious...
