HAMLEY, J.

James Milton Long was tried for the crime of burglary in the second degree. The jury found him guilty. He moved for an arrest of judgment, on the ground that there had been no proof of some element of the crime charged. The trial court granted this motion and denied defendant's alternative motion for a new trial. The state appeals. Respondent has made no appearance in this court.
