This matter is before the court on certiorari, and the record of the case from the office of Alderman George P. Mellinger is now before this court.

From this record, it appears that a summons in trespass was issued on May 22, 1944, to one Ralph Rafel, a constable, apparently from Allegheny County, at least not a constable from Butler County, and this constable served Summons upon defendant, John T. Ford, at the latter's residence...
