Plaintiff in error, Ivan Yeargain, was on January 28, 1952, tried and convicted at a bench trial in the criminal court of Cook County for an unlawful sale of narcotic drugs to a minor, which offense was found to have been committed on October 30, 1951. His motions for a new trial and in arrest of judgment were denied and he was sentenced to the penitentiary for a term of not less than...
