Earll sued to recover the unpaid balance of $1,564.58 and interest on an unsecured promissory note of $2,000 signed by the Searls on August 14, 1943. The Searls pleaded usury as a defense and counterclaimed for $3,000, alleging breach of faith by Earll while he acted as agent for the Searls.
