In May, 1939, Sam Hryciuk, hereafter referred to as defendant, was tried and convicted by a jury in the criminal court of Cook County for the crime of rape and was sentenced to the penitentiary for the term of his life. Throughout the proceeding, defendant, who was then 19 years old, was represented by counsel of his choice. No immediate review of the judgment of conviction was sought...
