Plaintiff filed a complaint in assumpsit to recover the value of junk and waste material alleged to have been stolen and converted by defendants to their own use. Defendant Nathan Kimmel, individually and trading as Louis Kimmel's Son, filed a preliminary objection to the complaint, under Pa. R. C. P. 1017, which is now before the court for disposition.
