This is a motion made on behalf of the defendant to dismiss the indictment pending against him, charging him with the crime of assault in the first degree, upon the grounds that he has already been placed in jeopardy once upon this same indictment, and that to proceed to trial under this indictment would place him in double jeopardy, contrary to section 6 of article I of the New York Constitution...
