Plaintiff in error, Marion Johnson, was indicted by the grand jury of Winnebago County at the October, 1952, term of the circuit court. Counts 1, 2 and 3 of the indictment charged plaintiff in error with the murder of one Amos Floyd by shooting him with a pistol. The fourth count charged manslaughter.
