The plaintiff was convicted of murder in the first degree after a jury trial, and judgment was rendered upon the verdict on February 23, 1950. He appealed from this judgment. He also petitioned for a new trial on the ground of newly discovered evidence. A demurrer to his petition was sustained (King, J.), and he appealed from the judgment entered on the demurrer.
