In an information filed by the district attorney of Los Angeles County defendant was charged in Count I with the crime of engaging in bookmaking upon the result of a horse race, in violation of subdivision I, section 337a, of the Penal Code. In Count II he was charged with the offense of accepting a bet or wager upon the result of a horse race, in violation of subdivision VI, section 337a, of the Penal Code.
