In May of 1944, respondent and cross-appellant Graham commenced an action against the appellants herein, alleging that Graham and defendant Street had entered into a partnership for the purpose of purchasing and operating certain equipment; that the profits were to be equally divided; that defendants Street and Siegel conspired to exclude Graham from the partnership and defraud him of his interest; and praying that an accounting be had of the partnership...
