This is before us on preliminary objections of defendant Luca.

Plaintiff in his complaint in equity against Nicholas Luca and Philadelphia Saving Fund Society says that he is the surviving spouse of Frances V. Del Conte, who died January 7, 1954, leaving a will wherein and whereby she bequeathed to him the sum of $1,500 and after giving other legacies of lesser sums to relatives...
