The offense is rape of a female under the age of 18, — the punishment, 2 years.

At the time charged, the prosecutrix was 16 years old and living in the home of her parents at Havre, Montana.

At about 12:15 o'clock on the particular morning charged, the prosecutrix, sitting in her home, heard a loud noise coming from without, whereupon she slipped on her jacket and stepped into the street that passes in front of her home...
