In the trial court plaintiff in error was plaintiff and defendant in error was defendant. We shall refer to the parties as they there appeared.

On March 30, 1953 plaintiff filed his complaint alleging that on January 27, 1952 he was struck down by an automobile driven by defendant and bearing a South Carolina license plate. He alleged injuries received in the accident and demanded damages therefor.
