MILLWEE, Justice.

Appellant, Rennie Johnson, owner and operator of the Tip-On-Inn Cafe in North Little Rock, Arkansas, was charged by information with murder in the second degree for the killing of Jessie Lairy. Trial was had on November 20, 1953, and the jury returned a verdict of guilty of murder in the second degree, fixing punishment at confinement in the State penitentiary for 7 years. From that conviction comes this appeal.
