This is a zoning case. Appellant, the City of Waxahachie, acting in response to the application of Eldon Berry, adopted two amendatory ordinances, one on February 5th and one on February 28th of 1952, each purporting to amend the basic zoning ordinance adopted by the governing body of the city on April 6, 1937, the effect of each amendment being to change a vacant lot belonging to Berry from a "dwelling" to a "local retail" zone.
