MORRISON, Judge.

The offense is the unlawful transportation of whiskey in a dry area; the punishment, a fine of $100.

It was stipulated that Hopkins County was a dry area.

Deputy Sheriff Grayson testified in the absence of the jury that his superior had instructed him to watch the appellant and be on the lookout to see if he was selling whiskey. In the presence of the jury he testified that he saw the appellant come out of the back door of his cafe...
