PRETTYMAN, Circuit Judge.
The appellee, Lattimore, was indicted under the District of Columbia statute1 in seven counts for perjury allegedly committed while he was testifying before a Subcommittee of the Senate Judiciary Committee. Upon a motion to dismiss, the District Court dismissed Counts I, III, IV and VII. The United States appealed from that order.
