This litigation arises from a serious hit and run automobile accident. At about 6:00 p.m., July 11, 1951, the automobile owned and operated by the appellee, Harold Blackburn, was struck by a coal truck on highway No. 80 near the mouth of Marrowbone Creek in Pike County.
