This Federal Employers' Liability Act1 case resulted in a verdict and judgment for plaintiff, and defendant appeals.

At the time of plaintiff's injury, he was the foreman in charge of a crew of defendant's employees who were engaged in resurfacing the Wyoming Avenue bridge in Philadelphia. That bridge carries vehicular and pedestrian traffic over the single-track, Oxford branch of the defendant railroad....
