RILEY, Judge.

Wayne Stalnaker, a member of the law enforcement division of the Conservation Commission of West Virginia, was indicted in the Circuit Court of Gilmer County for the malicious and unlawful wounding of Okey L. Davis; and was found not guilty of the charge of malicious wounding, but was convicted of the unlawful wounding charged in the indictment and sentenced to ten months' confinement in the Gilmer County jail...
