ARRINGTON, J.

The appellant, Malone Burgess, was tried and convicted on affidavit charging him with the unlawful possession of intoxicating liquor. It appears that the sheriff sent two of his deputies to search the premises for intoxicating liquor, where the defendant owned and operated a service station and garage, and that they had a search warrant for that purpose, issued pursuant to an affidavit for the search warrant.
