On April 8, 1952, Kehlor filed his petition for a writ of mandate in the Superior Court of Stanislaus County praying for an order of that court directing the respondent Municipal Court of the city of Modesto to dismiss a criminal complaint which was then pending against him in said court. On April 28th, following a hearing on the petition, the same was denied and petitioner thereupon appealed to this court.
