This is a tort action wherein the plaintiff seeks to recover the sum of $17,764 as damages sustained by him as the result of an assault and battery committed on him by the defendant. It is alleged that the assault and battery occurred on February 19, 1951, at about 5:45 P. M. when the defendant shot the plaintiff in the back with a pistol.
