This is an appeal from a final decree in an election contest.

D.G. McQuagge had been the Tax Assessor of Bay County, Florida, for approximately 20 years and was the Democratic nominee for an additional term as a result of the Primary in May, 1952. D.G. McQuagge died on November 1, 1952, which was after the ballots had been printed for the General Election to be held on November 4, 1952. The name of D.G. McQuagge was the only name on the ballot...
