On March 26, 1948 plaintiff, while driving an automobile across the railroad tracks of the Indiana Harbor Belt Railroad Company at twenty-fifth avenue in Melrose Park, Illinois, was struck by the engine of a train operated by the Chicago, Milwaukee, St. Paul and Pacific Railroad Company. He was seriously injured, and upon trial, the jury returned a verdict of $45,000. The usual post-trial motions were overruled...
