Appellants were convicted under an indictment in one count charging both of them with the crime of rape committed on an Indian reservation in violation of Section 1153, Title 18, U.S.C., which provides: "Any Indian who commits against the person or property of another Indian or other person any of the following offenses, namely, * * * rape, * * * within the Indian country, shall be subject to the same laws and penalties as all other persons...
