YEAGER, Justice.

This is a criminal action prosecuted in the name of the State of Nebraska by the county attorney of Douglas County, Nebraska, in which Robert William Losieau was defendant. The information was in two counts. The first count charged that the defendant was guilty of the crime of burglarly. By the second count it was charged that he was, within the meaning of law, an habitual criminal. He was tried to a jury on the first count.
