This is an appeal de novo from a conviction before the County Traffic Court of Hudson County, who imposed a penalty upon the defendant as a second offender under the following statute (R.S. 39:3-84.3):

"The owner of any commercial motor vehicle, tractor, trailer or semitrailer, whose vehicle shall be found on a highway in violation of this act or which shall have a gross weight of vehicle and load in excess of the gross weight...
