SIMPSON, Justice.

This is an action for personal injuries and property damage sustained by appellee in a collision of his motorcycle with the automobile of appellant.

The accident occurred in Birmingham at the intersection of 24th Street and Second Avenue, South, at about 2 p. m. on July 24, 1951. The 24th Street viaduct begins at the north line of Second Avenue.
