This suit was brought by the appellee bank and John W. Gillett, its liquidating agent, against Maurice Minchen, to recover funds of the bank which had been embezzled by its employee, John Clanton, and expended by Clanton on improvements on appellant's ranch. Appellee also sought to fix and foreclose an equitable lien against the entire ranch of appellant consisting of some forty-five thousand acres of land in Brewster County securing the repayment...
