Parties are referred to herein as in the trial court.

On January 6, 1933, Yahdeka Byrd, plaintiff herein, executed a deed of trust in which he named B.A. Marlin, defendant herein, as trustee of the "Yahdeka Byrd Trust". Marlin was given the general powers of a trustee with respect to all of Byrd's property; the trust was to expire five years from the date of execution of the deed of trust. Sometime thereafter...
