Plaintiff was sentenced in 1926 to imprisonment for life upon conviction of the murder of Sheriff Collings of Union County. He appealed and the judgment was affirmed. State v. Gibson, 204 Iowa 1306, 214 N.W. 743. The present proceeding is against the warden of the penitentiary where he has since been confined.
