This case was before this Court on a former appeal by plaintiff from a judgment of the Superior Court of Mecklenburg County granting defendant's plea in abatement and dismissing the action. The opinion of this Court on that appeal is reported in 237 N.C. 667, 75 S.E.2d 732. The factual situation is there set out in detail and need not be repeated here.
