HAMMOND, J., delivered the opinion of the Court.

This is an application for leave to appeal from a denial of a writ of habeas corpus by Judge E. Paul Mason, of the Supreme Bench of Baltimore City.

The petitioner was tried on May 11, 1949, on two indictments, one of which charged robbery and the other charged murder. He was tried under both indictments at the same time and was found not guilty of robbery but guilty of larceny, and not guilty of murder...
