The defendant, in driving his car from his home at Thompsonville, had occasion to cross the railway of the Chicago, North Shore & Milwaukee Railway Company at about five o'clock p. m. at a crossing of this track by the Ole Davidson road, also known as Highway 31, in Racine county.
