MAJOR, J.

This is a claim to recover damages for personal injuries sustained by the claimant on June 9, 1946, when he was struck on the head by a rock while an invitee of the State at Taughannock State Park.

This park was owned, constructed and maintained by the State, and open to the public particularly for the purpose of recreation.
