Defendants in error, owners of a 120-acre tract in what is referred to as the "Wildcat Jim" area of Carter county, Oklahoma, commenced this action as plaintiffs against the defendant, plaintiff in error herein, who is the assignee of an oil and gas lease on said tract, to cancel a major portion of said lease for breach of the implied covenant to further develop it.
