FINLEY, J.
The plaintiffs instituted an action in the superior court for Mason county to recover damages done to their oyster beds by defendants' allegedly negligent diversion of a stream. After a trial to the court, fact findings and conclusions of law adverse to the defendants were entered, and judgment was rendered thereon in the amount of five thousand dollars damages.
