LAWSON, Justice.

The appellant, Mattie Smarr, was indicted by a grand jury of Greene County on September 27, 1952, for the first degree murder of Ivory Posey.

Upon arraignment on November 27, 1952, accused pleaded not guilty and not guilty by reason of insanity. Trial was begun on December 8, 1952. On December 12, 1952, the jury returned a verdict of guilty of murder in the first degree and fixed punishment at death. Judgment and sentence were in accord with...
