Plaintiff filed an action for damages against defendants. The amended complaint was in two causes of action.

The first cause of action alleged, in substance, that defendant Cardinal Grocery Stores, a corporation, operated a grocery store in Nevada City and that defendant Foster was the manager and defendant Aaron was the assistant manager of the store; that on January 7, 1950, defendant Aaron, at the behest of defendant Foster, swore to criminal...
