This appeal is from a judgment of the district court dismissing plaintiff's demand as of non suit.

The demand is for damages for alleged partial breach of an alleged contract entered into between the parties, wherein defendant agreed to buy for and deliver to plaintiff twelve top grade cows, either with calves by their sides or to calve in December, 1950 or January, 1951.
