This appeal has been taken from a judgment in a habeas corpus proceeding instituted by James Milton Biggs and his wife. Marie Moselle Biggs, to obtain from Mr. and Mrs. Harvey Roberts the custody of their infant daughter, Deborah Sue.

Mr. and Mrs. Biggs, residents of Kilgore, Texas, were married in 1942 when the latter was only seventeen years of age. During the first eight years of their marriage...
