YEAGER, Justice.

This is an action for damages by John B. Peacock, plaintiff and appellee, against J. L. Brandeis & Sons, a corporation, defendant and appellant. The action is predicated upon a charge of negligence of an employee of defendant but attributable to it.

The case was tried to a jury and a verdict was returned in favor of the plaintiff for $17,500. Judgment was entered on the verdict. A motion for new trial was filed and in due course overruled...
