Levin, Seeds, of Chattanooga, Tennessee, against the appellees Kyle Brown and Evans McCulley, doing business as Brown and McCulley, a partnership at Tupelo, Mississippi, and which two suits were consolidated by agreement of the parties and tried as one cause.
