The material facts in this case are not in dispute. In July, 1950, the defendant Somerville Construction Company was engaged in the construction of a pipe line for the transmission of gas between Vermontville and Mulliken, a distance of approximately 10 miles. Defendant's employee, Ernest Graham, was in immediate charge of the work as job superintendent.
