On March 4, 1953, plaintiff instituted this action in trespass by filing a complaint in trespass, which was served on defendant on March 12, 1953. Defendant, through his counsel, entered an appearance on March 20, 1953, but no answer was filed to the complaint, so that the case is now at issue, and on April 8, 1953, counsel for plaintiff
