Early Bennett, appellee, sued Cecil Dixon, appellant, in Trespass to Try Title, alleging that he and appellant were owners of adjacent tracts of land, and that appellant was building a fence across appellee's land and seeking to appropriate the use of some 12 to 14 acres of appellee's land behind same.
